Please read these Terms of Service ("Terms") carefully before using the website at cleankernel.com or engaging any services provided by 17 Solutions LLC DBA Clean Kernel ("Clean Kernel," "we," "us," or "our"), located in Grafton, WI 53024. By using this website or our services, you agree to these Terms.
1. Services Provided
Clean Kernel provides the following services in the Ozaukee County, Wisconsin area and surrounding regions:
- IT Asset Disposition (ITAD) — Responsible collection, processing, and disposition of electronic devices for homes, businesses, and organizations.
- Secure Data Destruction — Certified erasure or physical destruction of storage media on computers, laptops, tablets, smartphones, servers, and other electronic devices.
- Laptop Resale & Refurbishment — Inspection, testing, cleaning, and resale of refurbished laptops and other electronics.
2. Quotes and Estimates
Quote requests submitted through our website are non-binding inquiries. A quote does not constitute a contract or commitment by either party until both parties expressly agree to specific terms in writing or verbally for a scheduled appointment. Actual pricing may vary based on device condition, quantity, and current market value.
3. Device Drop-Off and Pickup
By surrendering a device to Clean Kernel, you confirm that:
- You are the lawful owner of the device, or are authorized by the owner to dispose of it.
- You have removed any personal or sensitive data you wish to retain prior to drop-off, or you expressly authorize us to destroy all data on the device.
- You waive any claim to data remaining on the device once it has been accepted for processing.
- The device is not stolen, encumbered by a lease or lien, or subject to any legal hold that would prohibit its disposition.
Clean Kernel reserves the right to refuse any device at our sole discretion.
4. Data Destruction
We perform data destruction using methods consistent with Department of Defense (DoD) standards for digital media sanitization, or physical destruction where required. A certificate of data destruction is available upon request.
While we employ industry-standard processes, Clean Kernel does not guarantee that data cannot be recovered by highly sophisticated methods. Our liability for any data recovery following our certified destruction process is limited to the fees paid for that specific service.
We do not intentionally access, read, copy, or disclose any data found on devices submitted for destruction.
5. Refurbished Device Sales
Refurbished devices sold by Clean Kernel are tested and described to the best of our ability. Unless otherwise stated in writing at the time of sale:
- Devices are sold "as-is" with a 30-day limited warranty covering hardware defects present at the time of sale.
- The warranty does not cover damage caused by misuse, accidents, software issues, or modifications after purchase.
- Warranty claims must be submitted in writing within 30 days of purchase.
- Our sole obligation under this warranty is repair or replacement of the defective device at our discretion.
6. Environmental Compliance
Clean Kernel operates in compliance with Wisconsin's electronics recycling law (Wis. Stat. § 287.17), which prohibits disposal of computers and other electronics in Wisconsin landfills. Devices accepted by Clean Kernel are processed in a manner consistent with applicable state and federal environmental regulations. We maintain a zero-landfill policy for all accepted devices.
7. Payment
Payment terms are agreed upon at the time of service. We accept cash, check, and credit card. Pricing for data destruction services, device pickup, and resale proceeds are communicated in advance and must be agreed upon before services are rendered. Clean Kernel reserves the right to apply proceeds from device resale toward service fees unless otherwise agreed in writing.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Clean Kernel's total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid us for the specific service giving rise to the claim.
Clean Kernel is not liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, loss of data, or loss of business opportunity, even if advised of the possibility of such damages.
9. Indemnification
You agree to indemnify and hold harmless Clean Kernel, its members, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your misrepresentation of ownership or authority over a device, or your violation of any applicable law.
10. Website Use
You agree to use this website only for lawful purposes and in accordance with these Terms. You may not use this website to submit false information, attempt to circumvent spam protections, or engage in any conduct that could damage or impair the website or interfere with other users.
11. Intellectual Property
All content on this website, including text, graphics, logos, and code, is the property of 17 Solutions LLC DBA Clean Kernel or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ozaukee County, Wisconsin. You consent to the personal jurisdiction of these courts.
13. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page. Your continued use of our website or services after any changes constitutes acceptance of the updated Terms.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
